Court Adjourns Melaye’s Case Indefinitely On Health Grounds |RN

Justice Olasumbo Goodluck of FCT High Court, Maitama, on Thursday adjourned indefinitely the trial of Sen. Dino Melaye, docked for allegedly giving false information.

Melaye, representing Kogi West, was dragged to court on a two-count charge, bordering on giving false information, offences he denied committing.

The News Agency of Nigeria (NAN), recalls that the judge on Wednesday adjourned until May 17, and ordered the defence counsel to take appropriate steps to explain the absence of the defendant in court.

Goodluck in her ruling on Thursday, on a motion for adjournment by Mr Ricky Tarfa (SAN )Melaye’s counsel, held that the prosecution did not doubt the health problem of the senator.

“From the gamut of the entire facts placed before the court, the prosecution did not controvert the fact that the defendant was in the National Hospital’s Intensive Care Unit (ICU).’’

The judge, therefore, adjourned the case sine die (indefinitely) pending the recovery of the senator from his sickness.

Earlier, Tarfa, in an application to justify the absence of the senator, informed the court that his client was still lying critically ill at the National Hospital.

He tendered a medical report, signed by one Dr Olaniran, Director of Medical Services at the National Hospital, Abuja, which confirmed that the senator was being managed at the Intensive Care Unit.

Tarfa urged the judge to consider the ill health of the lawmaker as a special circumstance that warranted his absence from trial.
He urged the court to adjourn the trial pending the time his client would recuperate from the sickness, and be able to stand before the court to answer the two-count criminal charge against him.

Responding, the prosecuting counsel, Mr Magaji Labaran, urged the court to discountenance the exhibits attached to the defendant’s affidavit, as they did not meet the requirements of the Law.

He added that the elements in the medical reports did not indicate that the defendant cannot come to court to stand trial.

A Kogi State High Court has ordered that the senator representing Kogi West be moved to the National Hospital, Abuja.

The trial judge also adjourned till Monday, 7th, May for the continuation of hearing in a written bail application filed by Melaye’s counsel, Chief Mike Ozekhome, SAN, asking for a variation of the remand order placed on him.

This followed the refusal to grant bail to Dino Melaye on Thursday when he was hauled before a Senior Magistrates’ Court sitting in Lokoja, on seven counts bordering on criminal conspiracy and illegal possession of firearms.

The Chief justice of Kogi State, Justice Nadir Ajanah, who presided over the proceedings on Friday, said that in view of the critical health conditions as espoused by the council to the applicant, he should be moved to the National Hospital, Abuja, for proper medical attention.

Earlier, counsel to the defendant, Mike Ozekhome, had argued that Senator Dino Melaye was a chronic asthmatic patient who gasped for breath on Thursday while being arraigned and had to be given his special inhaler right there in the courtroom and in the presence of the trial magistrate, Sulyman Abdalah.

In an interview after the order, Ozekhome said that the judge was convinced beyond all reasonable doubts that the Police Clinic facilities in Lokoja could not meet the medical needs of Senator Dino Melaye.

“He also recognised the fact that as a senator of the Federal Republic, Dino cannot abandon his legislative duties and jump bail.

“Apart from this, his passport and other travel documents are in the possession of the Police, which makes it impossible to leave the country,” Ozekhome added.  (Punch)

The Nigeria Police has said, ” the Police Investigation Team re-arrested Senator Dino Melaye today, 2nd May 2018 after his arraignment at Chief Magistrate Court, Wuse”.

The disclosure was made in a statement by Force Public Relations Officer (FPRO), Mr Jimoh Moshood, an Assistant Commissioner of Police.

“Senator Dino Melaye was arraigned in court by the Police today, 2nd May 2018 at Chief Magistrate Court, Wuse, Abuja for Criminal conspiracy, causing damage to Government property, attempted suicide and escape from lawful custody. His arraignment in Court today was subsequent to his discharge from the National Hospital after he was confirmed fit for trial”, Moshood said.

This was as he recalled that, “on the 24th April, 2018, at about 1200Hrs, Sen. Dino Melaye while in lawful custody of the Nigeria Police Force and being taken for arraignment for Conspiracy and Unlawful Possession of Prohibited Firearms in Court in Lokoja, from Abuja, escaped from lawful custody when hoodlums and miscreants in Two (2) Toyota Hilux Vehicles blocked the Police vehicle conveying Senator Dino Melaye around Area 1 Round About, Abuja and in the process the Senator broke the side glass of the vehicle and jumped out of the Police bus through the window and was rescued from the Police men by hoodlums and miscreants to an unknown destination before he was rearrested at Zankli Hospital in Abuja later in the day on the same date.

“This case was investigated and that is why the Senator was arraigned in court today.”

The FPRO  added that the Senator representing Kogi West was rearrested ” for the pending offences of Criminal Conspiracy and Unlawful Possession of Prohibited Firearms already filed in a Court of competent jurisdiction in Lokoja for which he will be arraigned without further delay”.
