Atiku Targeted For Arrest Due To Insistence On Existence Of INEC Server —Spokesman, Paul Ibe

Presidential Candidate of PDP, Atiku Abubakar

Former Vice President and Presidential candidate of the Peoples Democratic Party, PDP, in the 2019 election, Atiku Abubakar, has raised alarm of plot to arrest him.

This was contained in a statement by his spokesman, Paul Ibe, on Sunday.

It said due to Atiku’s insistence of existence of a server used by the Independent National Electoral Commission (INEC), his enemies attributed a false comment on “mass protest” to him to prepare ground from his incarceration.

Ibe said: “I wish to emphatically state that such a statement did not emanate from Atiku Abubakar or his privies.

“It is the work of mischief makers who want to mar his spotless pro-democratic record and lay the ground work for their threatened actions against him on false charges of being a threat to national security.

“For the avoidance of doubt, Atiku Abubakar believes in the rule of law and in the laws of the Federal Republic of Nigeria. In his almost four decades in politics, he has never taken action or spoken words against democracy and will not start now.

“Atiku Abubakar and his team have confidence in God and thus call on those bent on mischief to have the fear of God and retrace their steps.

“Democracy has come to stay in Nigeria. The culture of fear being created now cannot rein in our democracy. Nigeria and Nigerians have a consistent history of outlasting tyranny and will continue to do so by the grace of God.”

JUST IN: Atiku Abubakar Condemns Shut Down Of AIT, Warns Against Dictatorship |The Republican News

PDP Presidential Candidate, Alhaji Atiku Abubakar

The announced suspension of the practising license of DAAR communication by the Nigeria Broadcasting Commission, NBC, is generating reactions from well-meaning Nigerians who see the action of the NBC as a calculated attempt by the FG to gag the media.

The presidential candidate of the Peoples Democratic Party, PDP, in the just-concluded presidential election, Atiku Abubakar has added his voice to the development. Atiku said he “received with trepidation reports of the withdrawal of the licenses of AIT and Ray Power owned by DAAR Group.

“The Gen. Buhari administration needs to be reminded that freedom of the press and of speech is not only fundamental to democracy, but it is also guaranteed by the constitution.

“Nothing untoward must be done to roll back our hard-earned democracy.”

Speaking via his twitter handle, Alhaji Atiku said “If at this time, we stand by as the Press loses its independence, there will be little to differentiate us from a dictatorship. This should not happen.

“I am a lifelong Democrat and throughout my political life, I have championed the principles of Separation of Powers. The Legislature has been challenged. The Judiciary has been tackled.” (Journalist101)

Atiku Alerts Public Of Plots To Link Him To Stage-managed Killings, Wants Lai Arrested

PDP presidential candidate, Alhaji Atiku Abubakar
**Wants Lai Mohammed arrested for security breach

Olalekan Adetayo and Olusola Fabiyi

The presidential candidate of the Peoples Democratic Party, Alhaji Atiku Abubakar, on Thursday, raised the alarm over alleged plan by some people to cause crisis in parts of the country and accuse him of being responsible for the skirmishes.

He said the plan, being spearheaded by “unscrupulous and anti-democratic elements,” for coming weeks, was aimed at smearing his personality.

Atiku made the allegation in a statement made available to journalists in Abuja by his media adviser, Paul Ibe.

He said the strategy was for some people to be apprehended for causing skirmishes and be made to mention Atiku and some members of the PDP as their sponsors.

The former Vice President also called for the arrest of the Minister of Information and Culture, Alhaji Lai Mohammed, for his unsubstantiated allegation against him.

The statement read, “We wish to blow the whistle as an early warning alert of the grandiose scheme being put together by some unscrupulous elements aimed at jeopardising the reputation of His Excellency Atiku Abubakar in the coming days and weeks.

“By the merit of what is beginning to unfold, there are plans to create some upset across the country whereby alleged perpetrators of such crimes will engage in phantom dropping of name of Atiku Abubakar and some senior personalities in the Peoples Democratic Party.

“Already, we are abreast of some other plans to plant fictitious stories in some mushroom media outlets aimed at discrediting Atiku and his political party, the PDP.

“It therefore becomes preponderant that we alert the public to this demonic plan and to say that it will be imprudent to compromise the peace and security of Nigerians in order to score a cheap political goal.

“Towards this end, and for the umpteenth time, we call on the Federal Government to be awake to its responsibilities of providing security and ensuring peace, and to desist from actions and utterances that are capable of exposing our fault lines.

“It is very unsettling that senior administration officials, especially those who are the mouthpiece of government will make reckless but calculated comments to tarnish the image of Atiku Abubakar and government will sit idly on it.

“With the conclusion reached by relevant security outfits that there is no proof to back the claim by Lai Mohammed that the opposition was planning to upstage the government, we demand that the information minister should be arrested for a breach of security and an apology tendered to Atiku Abubakar and the PDP.”

In its reaction, the Federal Government said the former Vice-President should have nothing to fear.

It said only the guilty were always afraid.

Minister of Information and Culture, Alhaji Lai Mohamed, who spoke to one of our correspondents on the matter, said he would not say more than that.

“On Atiku’s statement, I guess the former Vice-President must have been reading, in recent times, James Hadley Chase’s 1957 thriller entitled. ‘The Guilty are Afraid.’ That’s all I have to say.”

Justice Zainab Bulkachuwa Recuse Self As Chairman Presidential Election Petition Tribunal

Justice Zainab Bulkachuwa

The President of Court Appeal,  Justice Zainab Bulkachuwa has recused herself as the Chairman of 2019 Presidential Election Petition Tribunal hearing the petition against the election of President Muhammadu Buhari. Bulkachuwa voluntarily withdrew from participating in the hearing of the case shortly after the unanimous decision of the panel dismissing the application filed by the petitioner.

The ruling was delivered by a member of the panel, Justice Peter Ige.

She said that she took the decision for personal reasons and to avoid a situation where another female Justice will  face same issues presented to the court.

She said that the four man panel will continue with the case pending the announcement of the new chairman of the panel.

But the tribunal held that the petitioners have not placed enough materials of evidence before the court that the president of court of appeal will be biased in the matter.

The remaining four members of the panel have continued with case.

The Peoples Democratic Party (PDP) and it’s Pesidential Candidate, Atiku Abubakar on 16th of may 2019 filed a motion asking an order to ensure that Justice Zainab Bulkachuwa be recused from further sitting of the tribunal or participating in the proceedings in the petition and be replaced by another Justice of the Appeal Court.

They also averred that Justice Bulakchuwa is the biological mother to Aliyu Haidar-Abubakar a prominent card-carrying member of the All Progressive Congress.

It further averred that being the wife and mother of prominent card-carrying members of the APC which is the third respondent in the petition before the tribunal, there is every likelihood of bias if Justice Bulkachuwa remains as a member of the panel.

They also asserted that at the inaugural sitting of the tribunal the president of the appeal court while delivering her speech said “elections are held in Nigeria every four years into elective positions, no matter how well the election is conducted there are bound to be complaints.”

Her decision to step down is seen as a test of transparency of the process.(Sahara Reporters)

Atiku Abubakar Demands Apology And N5000m From Lauretta Onochie For Defamation

PDP presidential candidate, Atiku Abubakar and Buhari’s Special Aide on Socal media, Lauretta Onochie

by Oluchisim Fred

Atiku Abubakar, the PDP Presidential candidate in the 2019 election has demanded an apology and N500m from Lauretta Onochie over alleged defamation. Atiku through his lawyer Mike Ozekhome, threatened to begin a N2 billion suit against her if she refused to meet his demands, following her claims that he was placed on a watch list in the United Arab Emirates (UAE).

However, in a letter which countered the claim, Atiku Abubakar demanded an apology and N500m from Lauretta Onochie over the alleged defamation. He further asked her to publish a retraction in six national newspapers and one international daily, as well as on social media.

The letter reads: “Your odious publication is clearly also aimed at rubbishing our client’s image and reputation,” the letter read.“It has caused him national and international backlash and embarrassment and done incalculable damage to him. Your publication has also caused our client, in the eyes of reasonable members of the public, unspeakable odium, obloquy, hatred, ridicule and psychological trauma.“He has thereby been subjected to the shame and infamy of being viewed by members of the public as not only corrupt but as a terrorist and sponsor of terrorism. Numerous telephone calls, emails, visits, letters and private social media chats by his family members, friends, political and business associates, and international statesmen and women in the last few days attest to the alarm and serious concerns generated by your false publication.” (unclesuru)

Frank Timi Commends, Facebook, US. Firm For Exposing Buhari’s Fake News Israeli Political Consultant Firm

Muhammadu Buhari and Atiku Abubakar

by Ike A. Offor

Timi Frank, the former deputy national publicity secretary of All Progressive Congress, APC, and a political activist has publicly expressed his strong commendations for Facebook and the United States firm which exposed the Israeli disinformation company that has helped Buhari and APC to spread false and damaging news against the opposition party’s presidential candidate and the opposition party, PDP. Facebook has announced the closure of the Facebook page of the Israeli consultant company that has used its website and page to spread false news prior and after the 2019 presidential election. These fake news were used to sway the opinion of the Nigerian electorates, and helped to damage the image of Atiku Abubakar. Facebook said that it is doing more now to stop spread of fake news on its platform.

Facebook busted an Isreali-led campaign to sway elections in Nigeria as well as targeted countries in Africa, Asia and Latin America.

The social  media giant on Thursday said it had removed 265 Facebook and Instagram accounts, pages, groups and events linked to an Israel-based firm due to what it called “inauthentic behaviour” targeting users in Southeast Asia, Latin America and Africa.

The move is part of wider efforts by Facebook to address concerns over privacy lapses and hate speech in social media.

Facebook said the “inauthentic” activity originated in Israel and focused on Nigeria, Senegal, Togo, Angola, Niger and Tunisia as well as in Latin America and Southeast Asia.

Below is the press statement from Mr Timi Frank:

Press Release

A political activist and former Deputy National Publicuty Secretary of the All Progressives Congress (APC), Comrade Timi Frank, has commended a report released by a U.S.-based firm, Atlantic Council’s Digital Forensic Research Lab, for exposing an Isreali-based political consulting and lobbying firm named Archimedes, who has been coordinating false reports on social media against former Vice President Atiku Abubakar.

According to a news report published on Friday by Associated Press (AP), titled: “Isreali disinformation campaign targeted Nigerian election”, Frank said that Facebook had on Thursday banned Archimedes from the platform over its “coordinated and deceptive behavior” as well as conducted a sweeping takedown of dozens of accounts and hundreds of pages primarily aimed at disrupting elections in African countries, with some scattered activity in Southeast Asia and Latin America.

The report specifically revealed that the Isreali-based firm (Archimedes) worked for President Muhammadu Buhari to smear his leading opponent, Atiku Abubakar during the last general elections.

Reacting to the development through a statement on Saturday, Frank said that the world will gradually know all the evil secret behind the declaration of Gen. Muhammadu Buhari as the winner of the last presidential election.

According to Frank, one of the pages that Facebook deleted on Thursday was filled with viral misinformation and direct attacks against Abubakar, the former vice president of Nigeria. The page’s banner image showed Abubakar as Darth Vader, the Star Wars villain, holding up a sign reading, “Make Nigeria Worse Again.”

He also quoted the AP’s report “that on the overall, the misleading accounts had reached some 2.8 million users, and the pages had engaged over 5,000 followers, according to Facebook’s estimates.”

While thanking Facebook for bringing down the fake accounts, Frank said that “Nigerians ought to be worried about how the APC-led government is spending huge amount of money just to discredit the rightful winner of the 2019 presidential election, Atiku Abubakar.

“I believe that if a lie goes on for 20 years, truth will definitely catchup with it one day. It will not be long before Nigerians will realise how desperate and fake President Muhammadu Buhari is in his bid to hang onto power.”

The political activist called on the international community to note the Associated Press’ report and the extent of damage done to the main opposition party in Nigeria and its Presidential candidate during the last general election.

“The AP’s report has clearly shown the level of lies sponsored against Atiku during and after the last general election. The campaign of calumny has not stopped but Nigerians should henceforth disregard malicious reports in the social media against the former VP,” Frank stated

Nnmadi Kanu Releases ‘Proofs’ Surrounding Buhari’s Nationality, Says He’s Not A Nigerian |The Republican News

Mazi Nnami Kanu, the leader of the proscribed Indigenous People of Biafra has released some new ‘proofs’ that Buhari is not a Nigerian.

The leader of the Indigenous People of Biafra, Mazi Nnamdi Kanu, has come up with a fresh claim about the true nationality of President Muhmmadu Buhari.

Kanu, in his broadcast from the United Kingdom at the weekend, said that neither “dead” Muhammadu Buhari, nor “his replacement” Jibril al Sudani, is qualified to contest for Nigeria’s presidential election.

Nnamdi Kanu argued that being born on Nigerian soil was not enough to qualify one as a Nigerian citizen by birth, unless the parents, grandparents of such person is also born in Nigeria.

The IPOB leader said that Buhari’s father, Hardo Adamu, was a nomadic FULANI trader, a duck seller, from Niger Republic and later became a bodyguard in the Emir of Daura’s palace, which made him to settle in Daura, Katsina State, adding that he (Hardo) was borne in Niger Republic, not Nigeria.

Kanu said that the All Progressives Congress, APC, has opened the door by challenging Atiku’s citizenship by BIRTH, it now lies within the rights of every right-thinking person to also question Buhari’s citizenship by birth, even litigate it in Court.

He added, “NEITHER THE DEAD BUHARI NOR HIS REPLACEMENT JUBRIL AL-SUDANI IS A CITIZEN OF NIGERIA BY BIRTH ACCORDING TO SECTION 25 OF THE CONSTITUTION OF THE FEDERAL REPUBLIC OF NIGERIA

“Buhari, even before his death should not have contested for the presidency how much less the impostor Jubril Al-Sudani.

“Section 25 (1) of the badly worded, badly written 1999 Nigerian Constitution states that being born on Nigerian soil is not enough to qualify you as a Nigerian citizen by BIRTH, unless your father, mother, grandfather or grandmother is also born in Nigeria:

“According to the highest (Supreme) law in Nigeria which is the constitution, ‘The following persons are citizens of Nigeria by BIRTH-namely:

“(a) every person born in Nigeria BEFORE the date of independence, EITHER of whose parents or ANY of whose grandparents belongs or belonged to a community INDIGENOUS to Nigeria;

“Provided that a person shall NOT become a citizen of Nigeria by virtue of this section if NEITHER of his parents nor any of his grandparents was BORN in Nigeria.

“In simple/plain English this means that if NONE of your parents or grandparents is BORN in Nigeria, you cannot contest for the office of the president of the Federal Republic of Nigeria, simple and short.

“Section 131 of the 1999 Constitution which APC is relying on to disqualify Atiku, provides:

“‘A person shall be qualified for election to the office of the President if –

(a) he is a citizen of Nigeria by BIRTH.’

“Now, leaving that of Atiku for the moment, let us now consider whether the dead Buhari (now replaced by Jibril from Sudan) was a citizen of Nigeria by BIRTH, as defined under Section 25 of the Constitution of the Federal Republic of Nigeria (CFRN) above.

“Keep in mind that Section 25 did not provide being born in Nigeria as the ONLY conditions for being considered being Nigerian by BIRTH. There are other conditions, which one must fulfil and they are:

“1. As applied to Buhari, you must have been born before Independence, so having been borne in 1942, the dead Buhari passed this first test.

“2. Either of Buhari’s parents or any of his parents must belong to a tribe INDIGENOUS to Nigeria; and … [mind you not Republic of Niger]

“3. Under the Proviso to Section 25, either of them MUST also be BORN in Nigeria. [This is the most important proviso because even if you pass 1 and 2, you will still fail and won’t qualify to be Nigerian president if you don’t pass No 3, that is what the law says].

“Now, we know from public records that Buhari’s father, Hardo Adamu, was a nomadic FULANI trader, a duck seller, from Niger Republic and later became a bodyguard in the Emir of Daura’s palace, which made him to settle in Daura, Katsina State. So, he (Hardo) was borne in Niger Republic, not Nigeria.

“And Buhari’s father, being from Niger DID NOT belong to a tribe indigenous to Nigeria. This law was designed to stop cross border tribes from claiming indigenous identity to run for the presidency of Nigeria. Remember that the Yoruba tribe extends into Benin Republic.

“Though they are Yoruba by indigenous identity, they are not regarded as a population indigenous to Nigeria by virtue of the fact that they belong to another country. The same applies to Fulani people indigenous to Niger Republic that share common porous border with Nigeria.

“But given that Section 25 used the words ‘either of the parents or any of the grand parents’, we shall consider whether Buhari’s mother, Zulaihatu, was born in Nigeria.

“What we know for sure is that Hardo Adamu married Zulaihatu in Niger Republic and both of them, being nomadic, emigrated to Daura together sometime in early 1941. That is why there is NO record of any local Daura family in present day Katsina State that claims Zulaihatu comes from them.

“In other words, Buhari’s mother, also a Fulani from Niger Republic was NOT born in Nigeria.

“Now, here’s the question: if neither of Buhari’s parents were BORN in Nigeria, is it likely that any of his grandparents, that is the parents of Hardo and Zulaihatu were born in Nigeria? Not likely. This is where I challenge the Daura Emirate of Katsina to confirm or deny this.

“Let us now recall the Proviso to Section 25 which states, and I quote: ‘Provided that a person shall NOT become a citizen of Nigeria by virtue of this section if NEITHER of his parents nor any of his grandparents was BORN in Nigeria.”

“So, now we know that even though the late Buhari may have been born in Daura in present day Katsina State, NEITHER of his parents or grandparents were born in Nigeria. Buhari is therefore NOT a citizen of Nigeria by BIRTH as defined in the Proviso to Section 25 of the 1999 Constitution of the Federal Republic of Nigeria.

“So, even if they now claim that the Fulani is indigenous to Nigeria, Buhari still failed the FINAL and ultimate test of his parents or grandparents not being born in Nigeria.

“So, given that APC has opened the door by challenging Atiku’s citizenship by BIRTH, it now lies within the rights of every right-thinking person to also question Buhari’s citizenship by BIRTH, even litigate it in Court.”

INEC Lied, We Transmitted Results To Their Servers – Presiding Officers Claim |RN

By Politics Times

INEC

Some presiding officers of the Independent National Electoral Commission (INEC) has said they transmitted official results from their polling units to the servers of the electoral body.

Their claims contradict the position of the commission which earlier claimed it did not transmit the result of this year’s presidential election electronically.

Atiku Abubakar, the candidate of the Peoples Democratic Party (PDP) who lost the presidential election to President Muhammadu Buhari, had petitioned the Presidential Election Tribunal over the outcome of the exercise.

Mr Abubakar, a former vice president said results from the servers of INEC clearly showed he won the election with 18,356,732 votes against Buhari’s 16,741,430 votes but INEC overturned his victory by claiming the president got 15,191,847 votes as against the  11,262,978 votes attributed to him.

But distancing itself from the claims of the former vice president, the electoral body denied it collated or transmitted results of the election to its servers online.

However, the submission of some presiding officers that conducted the election does not tally with the position of INEC.

They claimed that they were personally trained by the commission on how to transmit the result of the election to the commission’s servers.

This was made known in the petition filed by Atiku and his party through the respective Witness Statement of Oath they made.

According to News Telegraph, one of the PO from Borno State claimed to have received training on how to discharge his duties on the day of the exercise.

“I was employed as an ad hoc staff and trained for three days by the 1st Respondent at the Government College, Maiduguri, Bomo State to serve as a Presiding Officer (PO) at Waliri Polling Unit with Code 003, of Shehun Barna Ward, Bomo State on the 23rd February, 2019 Presidential and National Assembly (Senate and House of Representatives) elections,” the witness said.

“The training covered the duties of all 1st Respondent’s ad-hoc staff at the polling units and the procedure for the conduct of election which includes accreditation, verification, authentication, collation and transmission of results as well as the use of Smart Card Reader (SCR), amongst others.

“At the 1st Respondent training, we were specifically instructed that the use of the Smart Card Reader for accreditation, verification, authentication, collation and transmission of results is mandatory and that any election conducted without the use of the Smart Card Reader would be invalid.

“I took part in the conduct of the Presidential and National Assembly (Senate and House of Representatives) elections of 23rd February, 2019 where I served as the Presiding Officer (PO) and I ensured the use of the Smart Card Reader for accreditation, verification, authentication, collation and transmission of votes in my polling unit.

“At the end of voting, the information on the Smart Card Reader with the results inclusive, were collated by me in the presence of the party agents and other ad-hoc staff of the 1st Respondent after which my Assistant Presiding Officer (AP0-1) transmitted the result electronically in my presence to the 1st Respondent’s server, using the Smart Card Reader (SCR) and the code provided by the 1st Respondent.”

Furthermore, in the witness statements of the Presiding Officer of Daza Primary School Code 001,Daze Marte Ward of Borno State, who was coded as BU; the Presiding Officer of Mustapha Ali Bama, Code 036, Mafoni MCC Ward, who was coded IM; the Presiding Officer of Binkalion Code 003, Maisandari Damaturu ward Yobe, coded as AB and APO of Kafan Sarki Code 007, Yabir-Gujba of Yobe state, coded as AW; they all admitted that the results of the Presidential election were transmitted electronically to INEC’s server.  (Politicstimes)

How Obasanjo Revealed That Atiku Is Not Nigerian — Ajulo |The Republican News

PDP presidential candidate, Atiku Abubakar

A lawyer and former National Secretary of the Labour Party, LP, Olukayode Ajulo, has stated that being a former Vice President does not automatically qualify the presidential candidate of the Peoples Democratic Party, PDP, Alhaji Atiku Abubakar, to contest for the presidency.

Ajulo, an All Progressives Congress, APC, lawyer, stated this while fielding questions from The Sun on issues relating to the contention of the nationality of Atiku.

According to the lawyer, it was even former President Olusegun Obasanjo that inspired the thought that Atiku is not Nigerian when he raised the issue of the former Vice President being of ‘dubious parental background’ in his book, ‘My Watch.’

He said, “President Olusegun Obasanjo inspired that thought and this further inspired me to go into research to know who is a Nigerian citizen by birth because if somebody who had not only worked with Atiku but was also the president then can raise this issue of Atiku being of ‘dubious parental background’ in his book, ‘My Watch,’ then there must be more than what meets the eyes.

“My position is still unchanged, and that is, that Atiku was a vice president is not an automatic qualification to contest for the presidency.

“Long repetition of wrong occurrences, won’t make it right. In fact, in Australia, one of their members of Parliament had to resign when it was discovered that his nationality was questionable.

“I don’t think ours is beyond rectification and that is why the issue is being raised. I was a student when Atiku became a vice president. .

“As a lawyer, who must be on the right side of the law, I know my limits particularly when a matter is before the court; and as a counsel to one of the parties in the election, whatever I am going to say is going to be circumspect to the point that it will not prejudice the matter before the court.

“It is so clear beyond conjecture that the APC raised a lot of fundamental preliminary objections especially on the claim of Atiku that he has right to be nominated and voted for whereas the constitution has a special condition that to be able to be voted for as the president you must be a Nigerian citizen by birth.

“Yes, it is true that no one should be prejudiced by the circumstances of his birth. However, there is an exception for every right. For example, there is a right to freedom of speech and however this right is still circumscribed by the right of other persons.

“Therefore, your right must be exercised within the ambit of the law. For example, you can’t say you have a right to freedom of movement and then find your way to my bedroom, without authorisation or justification, I will deal with you.

“The constitution stipulates the condition precedent to the right Atiku is laying claim to and I am of the view that he has not, in fact, and cannot, fulfil that condition precedent.” (Daily Post)

I Am Nigerian By Birth, Says Atiku With Proofs |The Republican News

PDP presidential candidate, Atiku Abubakar

by Adioolayi

The Peoples Democratic Party’ s candidate in the February 23 presidential election , Alhaji Atiku Abubakar , has denied the All Progressives Congress’ allegation that he is not eligible to contest because he was not born in Nigeria .
Atiku stated this in a response to the APC’s reply to the petition he and his party jointly filed before the Presidential Election Petitions Tribunal.

He said he was born on November 25, 1946, in Jada, Adamawa State, therefore he was a Nigerian.
The APC had alleged in its response that as of November 25, 1946, when Atiku was born , Jada, was part of Northern Cameroon .

But Atiku insisted that he was a Nigerian citizen, adding that his parents were also Nigerians by birth.
He said while his father, Garba Atiku Abdulkadir , hailed from Wumo in the present day Sokoto State, his mother, Aisha Kande, hailed from Dutse, now Jigawa State.
Atiku and the PDP said, “Contrary to the allegations contained in paragraphs 1 , 2 , 3 , 4 , 5 and 6 of the 3rd respondent’s ( APC’s) reply, the petitioners state that the 1st petitioner ( Atiku ) is a citizen of Nigeria by birth and thus qualified to vote and be voted for and returned in the election to the office of the President of the Federal Republic of Nigeria, held on Saturday February 23, 2019 going by the relevant provisions of the 1999 Constitution (as amended).

“The 1st petitioner was born on November 25, 1946, in Jada, Adamawa State, by Nigerian parents and he is, therefore, a citizen of Nigeria by birth.

“The 1st petitioner’s father, Garba Atiku Abdulkadir, was a Nigerian by birth who hailed from Wumo in the present day Sokoto State, while the mother, Aisha Kande , was also a Nigerian who hailed from Dutse in the present day Jigawa State.

“The parents of the 1st petitioner are both Fulani, a community/tribe indigenous to Nigeria .
“The birth of the 1st petitioner in Jada, in the present-day Adamawa State of Nigeria, was occasioned by the movement of his paternal grandfather called Atiku, who was an itinerant trader, from Wumo in the present-day Sokoto State to Jada in company of his friend , Ardo Usman.

“That in Jada, Atiku, the grandfather of the 1st petitioner, gave birth to Garba who in turn gave birth to the 1st petitioner and named him after his father, Atiku .

“The 1st petitioner’s mother, Aisha Kande, was the grand daughter of Inuwa Dutse who came to Jada as an itinerant trader too from Dutse in the present-day Jigawa State.
All averments concerning Germany, British Cameroons , League of Nations and Plebiscite are false and misleading in relation to the 1st petitioner and therefore completely irrelevant more so that the 1st petitioner is a Nigerian by birth within the contemplation of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).
“The averments in the aforesaid paragraphs are indeed fabricated, contrived, made in bad faith and designed to embarrass the 1st petitioner. ”

The Independent National Electoral Commission had on February 27, 2019, declared that the All Progressives Congress alongside its candidate, President Muhammadu Buhari, won the February 23 election with 15,191, 847 votes to defeat his closest rival, Atiku, whom it said polled 11,262,978 votes.

But the petitioners stated that “from the data in the 1st respondent’s ( INEC’s) server … the true, actual and correct results” from “state-to -state computation” showed that Atiku polled a total of 18,356,732 votes defeat Buhari whom they said scored 16,741,430 votes.
INEC had in its response to the petition distanced itself from the “server results.”

The commission, through its lead counsel, Yunus Usman ( SAN ) , had said the results of the poll were never transmitted or collated electronically.
It added that it kept no such server where such electronically transmitted results could have been obtained.

In their reply to the APC’s reply, Atiku and the PDP insisted that they truly got authentic results of the February 23 election from the Independent National Electoral Commission’s server.
They said, “In reaction to paragraph 29 of the 3rd respondent’s reply, the petitioners aver that the data and scores in the 1st respondent’s server were as transmitted by the 1st respondent’s officials and those scores are valid, and legitimate.

“The conduct of elections and declarations of results by the 1st respondent is the subject of the present petition.
“Contrary to paragraphs 31 and 34 of the 3rd respondent’s reply, the petitioners contend that the figures and scores in paragraph 22 of the petition are neither false nor contrived or concocted by the petitioners .

“Indeed, the adhoc staff and officials of the 1st respondent in obedience to the training/instruction by the 1st respondent (INEC) transmitted the scores they got from the polling units to the 1st respondent’s server.” (Punch)
