Aloy Ejimakor, lawyer of the leader of the Indigenous People of Biafra, Nnamdi Kanu, has lamented that Nigeria misled Kenya to expel the separatist to the country.

In a statement on Sunday, he explained that pro-Biafra agitator is “technically still in Kenya.”

Ejimakor noted that since Kanu travelled to Kenya on a British passport, he should have been expelled to the same country and not Nigeria.

Ejimakor, in a statement he signed entitled: “Kanu is technically still in Kenya,” said it was dubious that Kenya attributed Kanu’s citizenship to Nigeria because it’s his place of birth.

The statement read in part, “Yes, that’s right: In the purest interpretations of foreign relations law, as applied to Britain and Kenya, Mazi Nnamdi Kanu is technically speaking, still in Kenya. How? Dual national or not, Kanu departed Britain and travelled to Kenya as a British citizen and Kenya admitted him as such. That’s the starting point.

“So, after his admission to Kenya, it happens that Kanu must be expelled from Kenyan soil (with or without due process), the next natural and legal thing to do is for Kenya to expel him to Britain, not Nigeria. Choosing to expel him to Nigeria means that he could’ve also been expelled to any other country than Nigeria.

“Why? Because Kanu presented himself to Kenya as a British citizen, not a Nigerian citizen or even a dual citizen. In international law, it was clearly a three-way immigration contract between Kanu, Britain and Kenya. Nigeria was not a party to it; and Nigeria was never in reckoning at the Kenyan port of entry when Kanu presented himself for admission. Lawyers call it the privity of contract.

“Counting from the time of Kanu’s abduction to the infamous rendition, Kenya sighted no other travel document that could’ve, in addition to Britain, attributed another nationality to Kanu, including that of Nigeria. Or, was Kanu admitted to Kenya on a Nigerian birth certificate?

“So, it’s dubious that Kenya attributed Nigerian citizenship to Kanu because sponsors of the abduction and rendition presumably told Kenya that Kanu was born in Nigeria.”

Kanu, 53, was arrested in late 2015 after calling for a separate homeland for the Igbo people in South East Nigeria.

In 2017, he jumped bail, reappearing in Israel and Britain, after attempt was made on his life by the Nigerian army.

On June 29, Nigeria’s justice minister and attorney general, Abubakar Malami, announced Kanu had been “brought back to Nigeria in order to continue facing trial after disappearing.”

The government said last month that Kanu was “brought back” to Nigeria in order to face justice, but gave no details. His family and lawyers say he was taken in Kenya.

His charges include “terrorism, treasonable felony, managing an unlawful society, publication of defamatory matter, illegal posession of firearms and improper importation of goods, among others,” Malami said.

Nigeria’s Attorney General and Minister of Justice, Abubakar Malami (SAN) on Tuesday, June 29, 2021, confirmed that Kanu had been rearrested.

At a joint press briefing with the State Security Service (SSS), also known as the Department of State Services (DSS) in Abuja, Malami said Kanu was rearrested and returned to Nigeria on Sunday, June 27.

He did not, however, give details of where Kanu was arrested and the diplomatic collaborations that may have been involved in the operation.

According to him, the IPOB leader was arrested through “collaborative efforts of Nigerian intelligence and security services”.

Kanu, who is being prosecuted on charges of treasonable felony, was thereafter arraigned at the Federal High Court in Abuja. It was his first court appearance since he fled Nigeria in September 2017 after an invasion of his home by the military in Afara-Ukwu, near Umuahia in Abia State.

“Kanu had arrived in Kenya and settled down in a house. On June 19, 2021, he drove himself in a car to the international airport to meet a person arriving in the country for a high-level IPOB meeting.

“He was travelling on a British passport, not a Nigerian passport as alleged by Malami. He was brought into Nigeria on a Saturday and arraigned on Monday.

“Buhari upon learning of his abduction decided to cancel his trip to the UK to manage the diplomatic fallouts at home instead of going to London.

“Kanu was interrogated in the presence of his lawyers in the DSS office in Abuja. The Nigerian government didn’t get his passport, laptop, and three major phones.

“He was taken out of Kenya without passing through immigration.”

There have been reports that INTERPOL was involved in Kanu’s arrest but the top dismissed that, saying “INTERPOL wasn’t involved”.

UK Newspaper, The Guardian, had reported that Kanu got a Kenya visa which was to expire in June, and he had been around in the country before his sudden arrest and extradition.

“Evidence seen by the Guardian shows Kanu entered Kenya this year on his British passport on a visa expiring in June. His UK passport remains in Kenya. Kanu was not in possession of a Nigerian passport, his family said, and he has verbally renounced his Nigerian citizenship in broadcasts.

“The abduction of a person from a foreign country with the aim of rendition to justice is illegal under international law,” the UK newspaper report says.

SaharaReporters had on Wednesday reported that Kanu recounted his experience in Kenya while speaking with his lawyer, Ifeanyi Ejiofor, saying he was “mercilessly beaten and tortured” in the East African country before his extradition to Nigeria.

Ejiofor had confirmed the words of Kanu during an interview, adding that Kanu told him how he was detained, not in any Kenya official detention centre but a private residence for about eight days, before his extradition to Nigeria.

The lawyer had said, “There was a clear collaboration between the Kenya government and the Nigerian government. I am happy that they now deny the fact that Kanu was arrested there.

“But by the time we finish with them at the International Criminal Court, they will never remain the same. He was arrested at the airport there, and he was taken to an unknown residence. He was subjected to inhuman treatment.

“Kanu was tortured, maltreated, and mercilessly beaten, as confirmed by him to us. After spending eight days in their illegal custody, they now beckoned to the Nigerian government. Kanu was lifeless and unconscious by the time they were bringing him to Nigeria.

“To tell you the level of their conspiracy and the desperation to get him, they brought him here on a Sunday and the federal government is fully aware that I am his legal counsel.

“He was brought into the country and inflicted with several injuries and he is having many medical issues today. It was at the behest of the Federal government that Kenya was doing those things. This is against all international laws. We are going to address an international court at that level.”

The Kenyan authorities had denied that they had anything to do with the arrest and extradition of Kanu to Nigeria. (SaharaReporters)

The Okechukwu Isiguzoro-led Ohanaeze group wondered the rationale and idea behind the drama.

According to the OYC, the display may have been carried out to make the service chiefs appear capable or “resist the idea of sacking them from office.”

OYC, in a statement signed by Mazi Okechukwu Isiguzoro, its President General and Mazi okwu Nnabuike, Secretary General, also said the leader of Boko Haram, Abubakar Shekau provided the new blankets displayed by the 344 abducted pupils.

“The evidence of (provisions of) new blankets for over 344 pupils of Kankara boys by Boko haram insurgents makes the abduction fake or jankara and organizers of the drama as amateurs.

“Northern leaders have refused to accept their leadership failures in governance, most of their political leaders are behind the insecurity situations in the north and are benefiting immensely from the huge budgetary allocations mapped out for insecurity challenges, the Kankara boys abduction is business as usual for Northern leaders.”

President Muhammadu Buhari has announced that he would not hesitate to punish security chiefs if any case of abduction is recorded in any part of the country.

He said he had directed them to beef up security around all schools.

He also warned those who described as “politicising” security issues, saying the security agents would “deal with” them.

Buhari made the pronouncements on Friday during the reception held for the released Dapchi girls and their parents at the Presidential Villa, Abuja.

The President said, “The security services have since been directed to put in place further measures around all schools vulnerable to attacks to ensure the safety of our pupils/students and teachers and school workers.

“I have tasked all the security agencies to work to ensure that we do not witness any recurrence of these incidents.

“Security chiefs have been warned in clear terms that any lapse on their parts will be viewed seriously,” he said.

As for those who he referred to as “politicising the security situation in the country”, Buhari urged them to “desist or face the wrath of security agencies.”

“May I also warn against those elements who have chosen to make a political fortune of our citizens’ misfortune.

“Government would not tolerate any attempt by any person or group to trivialise or politicise security issues for politically motivated ends.

“Accordingly, security agencies would not hesitate to decisively deal with such unscrupulous characters,” he said.     (Punch)
